REILLY POZNER COMPLETES CLOSING ARGUMENTS IN $108M BANK TRUSTEE BREACH OF DUTY CASE

Reilly Pozner has completed closing arguments in a Missouri federal court case over the mishandling of insolvent National Prearranged Services Inc. (NPS) funeral funds. The case was brought by Jo Ann Howard and Associates, P.C., the Special Deputy Receiver, a group of state guaranty associations and its national organization, the National Organization of Life and Health Insurance Guaranty Associations (NOLHGA). The case arose out of a nationwide Ponzi scheme by NPS, a Missouri-based seller of pre-need funeral contracts.

Reilly Pozner has been retained to represent a coalition including the City of Denver and sixteen fellow Colorado local governments who have joined together to take a stand in filing suit against 20 manufacturers and distributors of prescription opioids. The lawsuit aims to hold the defendants accountable for the far-reaching effects on residents and government budgets.

RP Law Successful in Years-long Case

Reilly Pozner has prevailed in a years-long case State of Colorado v. The Castle Law Group, LLC, et al. The judge in the case awarded a victory to RP Law’s client Castle Law Group, including awarding legal fees totaling $1.9 million.
Colorado Attorney General Cynthia Coffman claimed that the defendants including the foreclosure law firm and also former partners Larry and Caren padded billings in order to take in millions in illegitimate profits from the banks they represented, as well as the affected homeowners and real estate investors who later bought the foreclosed houses at auction. In April 2017, Denver District Judge Morris Hoffman ruled against the state, arguing in a 92-page opinion that neither the Castles nor the other defendants took advantage of the position banks were in to move foreclosures quickly during the housing crisis.”

RP Law is pleased to welcome John McHugh and Michael Robertson as Partners of the firm effective January 1, 2018.
John is a skilled trial attorney with a wide civil practice that includes experience in cases in the financial services, insurance, and energy industries. He was the lead attorney in the landmark lawsuit that challenged Colorado’s laws that prohibit same-sex marriage.
Since becoming an attorney, John has worked on high-stakes and notable matters. At Reilly Pozner, he has enjoyed representing prominent clients including professional sports teams, SEC investment advisors, and national title companies. Prior to joining Reilly Pozner, he was an associate with the international law firm Quinn Emanuel Urquhart & Sullivan in New York City.
John earned his law degree from New York University School of Law.

He utilizes his unique accounting background while working closely with his corporate clients and case experts oftentimes on highly-technical matters involving corporate finance, accounting, and tax law issues.

RP Law Handles $34M Travelport Tax Case Dismissal

Travelport, Inc., one of the world’s largest providers of travel reservation services, was assessed more than $34 million by Colorado Department of Revenue (CDOR) in corporate income taxes, interest, and penalties. RP Law’s Dan Reilly and Clare Pennington, along with income tax specialty firm Silverstein & Pomerantz LLP, successfully defended this client in having the case dismissed and CDOR withdrawing its claim.

The Colorado Department of Revenue sought more than $40 million in corporate income tax from TBI. After a two-week trial, the Court entered judgment reducing the tax assessment to $12.8 million.* RP Law attorneys Dan Reilly and Clare Pennington were lead counsel on the case.
